Abstract

In my study I review the expansion of the scope of tasks and competence of the judge overseeing the enforcement of sentences, as well as the changes of the rules relevant to the procedure of such judge, from the rules on the enforcement of sentences and measures entered into effect on 1st July 1979, to the penitentiary law entering into effect on 1st January 2015. The simplification of the procedures also means that the document based decision making has been pushed forward, which may as a result in my opinion restrict the detainee’s rights in some cases. At the same time the development clearly shows that the sensitivity towards the protection of the detainees’ rights has increased, and the judge overseeing the enforcement of sentences is an important element of the guarantee system surrounding the enforcement of sentences and measures. The penitentiary law enforces numerous constitutional principles and also created opportunity for compensation in case the housing conditions violate fundamental rights.
