A személyiségzavar, különösen a pszichopátia hatása a büntetőjogi felelősségre
Absztrakt
A személyiségzavar büntetőjogi felelősséget, illetve büntetéskiszabást érintő értékelésének kérdése rendre felmerül mind a hazai, mind a nemzetközi szakmai diskurzusokban. A személyiségzavarok büntetőjogi relevanciáját elsősorban a bűnelkövetők körében való felülreprezentáltságuk és a kriminalitással való szoros kapcsolatuk adja. A tanulmány interdiszciplináris kontextusban tárgyalja a személyiségzavarok büntetőjogi értékelést befolyásoló sajátosságait, külön kitérve a pszichopátiában tapasztalható – kriminológiailag jelentős – kognitív és érzelmi diszfunkciókra. A konklúzió – gondolatébresztő célzattal –röviden érint néhány, a tárgyalt kórkép büntetőjogi megítélésével kapcsolatos dilemmát.
