Changes in judicial practice related to the land transaction act after reforms of procedural acts

Abstract

Sales contract in respect of procedural law can be contested before the court in two ways in the case of transaction of agricultural land ownership by sales contract. On one hand, administrative   court   proceeding   may be initiate against the refusal of agricultural administrative body to approve a sales contract, and on the other hand, civil procedure may be initiated to declare the contract null and void. The possibility of simultaneous initiation of an administrative court proceeding and a civil proceeding by itself would not raise any problem. However, since 1 January 2018 two relevant changes concerning procedural law happened. The new Act CXXX of 2016 on the Code of Civil Procedure and the Act I of 2017 on the Code of Administrative Court Proceeding entered into force. The aim of the study is to examine, what kind of essential changes may take place in civil enforcement before courts and how the enforcement of rights for contracting parties will be.
