A mesterséges intelligencia versenyjogi vonatkozásai

Absztrakt

A mesterséges intelligencia (MI) és a versenyjog kapcsolata a gyorsan fejlődő technológiai környezetben egyre fontosabbá válik. A tanulmány a generatív mesterséges intelligencia (GenMI) értékláncának versenypiaci vonatkozásait és az MI alapú árazási algoritmusok esetleges versenyjogsértő hatásait vizsgálja. A GenMI-re vonatkozó szabályozási és versenyjogi beavatkozásoknak figyelembe kell venniük az innovációs hatásokat, miközben biztosítják a piaci versenyt, elkerülve a túlzott piaci dominanciát és az antitröszt kockázatokat. A tanulmány kitér arra, hogy a digitális piacokon a tipping jelenség és a BigTech cégek dominanciája különböző versenyjogi aggályokat vet fel, mint például az inputokhoz való hozzáférés korlátozása, saját szolgáltatások előnyben részesítése („self-preferencing”) és árukapcsolás. Az MI alapú árazási algoritmusok képesek lehetnek a versenytársak árazásának figyelemmel kísérésére és az árak módosítására, ami segítheti a versenykorlátozó megállapodások betartását, valamint a hallgatólagos összejátszást vagy összehangolt magatartást is elősegíthetik. A tanulmány összegzése szerint a GenMI és az MI alapú árazási algoritmusok versenyjogi megítélése összetett, és megfelelő szabályozási kereteket igényel a jövőben.
