Az emberi jogok védelmének garanciális elemei az új büntetés-végrehajtási kódexben

Abstract

The study is a written and edited version of the presentation performed at the meeting of the Hungarian Prison Association Legal Section 10 December 2015. The author’s analysis focuses on the protection of human rights and its significance while emphasizing the fragility of the balance between the individual and the community, furthermore the balance between the individual and the state. In this article the historical development of human rights and their grouping based on different viewpoints are discussed. Following those, the author outlines the current situation of the Hungarian Legislation from a special point of view, namely the connection between the penitentiary legal relations and the fundamental rights.
