International outlook - Healthcare and prison environment

Abstract

According to the International Covenant on Economic, Social and Cultural Rights (United Nations, 1966, Article 12.) prisoners also have the right to the highest attainable standard of physical and mental health. Thus those who are imprisoned retain their fundamental right to enjoy good health, both physical and mental. When a state deprives people of their liberty, it takes on a responsibility to look after their health. The aim of this study is to provide an overview of the complexity of the prisoners’ healthcare and to affect those problem drivers, which are noticeable in Europe in relation to the healthcare services. In addition to the above, this paper presents the case law of the European Court of Human Rights selected with regard to the prisoners’ health-related rights.
