Abstract

In the regulations of the European Union, the distinction between an economic service contract and a public service contract depends on the nature of the contract, the type of service and the relevant legislation. In general, the term “public service contract” refers to contracts that concern services of public interest, such as health, education, social services, postal services or transport services.
“Economic service contract” generally means a contract between private enterprises and the government or other public bodies
for the performance of economic activities that may be profit-oriented. Whether an economic service contract is considered a public service contract depends on what services the contract concerns and how these services are related to the public interest.
