Az uniós platformszabályozás és adatvédelmi jog feszültsége

Absztrakt

A felhasználók által az online platformokon közzétett tartalmak és a felhasználói fiókok elérhetőségének korlátozása és láthatóságának hátrasorolása a tartalommoderálás kevésbe szembetűnő, azonban annál hatékonyabb formái. A felhasználót érintő bármely korlátozásról szóló tájékoztatás hiánya (shadowbanning) azonban alapjaiban sérti a DSA indokolási kötelezettségét és a GDPR átláthatóság elvét. Jelen tanulmány a korlátozott számban elérhető európai hatósági és bírósági gyakorlat mentén mutatja be az online platformok shadowbanning gyakorlatának jogszerűségével és átláthatóságával szemben támasztott követelményeket.
