Korrupció és elszámoltatás a természetjogban
Absztrakt
A tanulmány a korrupció fogalmának történeti és jogfilozófiai fejlődését vizsgálja a természetjogi gondolkodástól a modern korrupcióelméletekig, különös figyelemmel az elszámoltathatóság kérdésére. Bemutatja, hogy Aquinói Szent Tamás, Grotius és Kant erkölcsfilozófiai megközelítéseit miként váltotta fel a klasszikus szociológia (különösen Weber és Durkheim) intézményi szemlélete, majd elemzi a principal-agent modell, a kollektív cselekvés elmélete és az állam foglyul ejtésének (state capture) koncepcióját. A tanulmány áttekinti a korszerű korrupcióellenes eszközöket, különös tekintettel az integritásalapú közigazgatásra, a vagyon-visszaszerzésre és a nemzetközi együttműködésre. Következtetése szerint a modern korrupció elleni fellépésnek a rendszerszintű visszaélésekre és azok gazdasági haszonélvezőire kell összpontosítania, miközben megőrzi a természetjogi hagyomány közjóra és közhatalmi felelősségre épülő alapértékeit.
