Digitális szuverenitás és fegyverré tett kölcsönös függés a digitális piacokon, különös tekintettel a szellemi alkotások jogára

Absztrakt

A tanulmány a globális digitális piacokban kialakult erőviszonyokat vizsgálja, különös tekintettel az Egyesült Államok, az Európai Unió és Kína közötti geopolitikai és szabályozási versengésre. A „fegyverré tett kölcsönös függés” (weaponized interdependence) elméleti keretére támaszkodva azt elemzi, hogy a digitális infrastruktúra kulcsfontosságú hálózati csomópontjaiként működő platformok miként válhatnak az állami befolyásgyakorlás és kényszerítés eszközeivé. Kitér emellett arra is, hogy az Európai Unió a digitális szuverenitás koncepciójára építve milyen szabályozási stratégiákkal igyekszik kezelni a digitális innováció terén fennálló strukturális lemaradását az Egyesült Államokkal és Kínával szemben. Külön figyelmet kap az adatok feletti kontroll jogi természete, amely kapcsán a tanulmány kritikai elemzésnek veti alá az adat, mint vagyoni értékkel bíró jogi tárgy és mint közjószág közötti normatív feszültséget. A szerző amellett érvel, hogy a technológiai világrend jelenlegi fragmentációja („splinternet”) közepette az európai stratégiai autonómia csak akkor tartható fenn, ha az Unió képes megerősíteni szabályozási önrendelkezését és biztosítani az adatok feletti tényleges kontrollt.
