Kína és a nemzetközi jog: jogi hadviselés (lawfare) vagy stratégiai jogalkalmazás?

Absztrakt

A nemzetközi jogi szakirodalomban az utóbbi két évtizedben nagy népszerűségre tett a jogi hadviselés (lawfare) koncepciója. Egyes szerzők véleménye szerint ez a nemzetközi jogi normák visszaélésszerű felhasználásának módszere, és különösen a dél-kínai-tengeri térségben gyakori területi jogviták során sokan azzal vádolják a Kínai Népköztársaságot, hogy ehhez a módszerhez folyamodik. A tanulmány célja annak vizsgálata, hogy vajon tényleg igazolható-e ez az állítás. Ennek érdekében a dolgozat első fele a lawfare koncepciót vizsgálja és bemutatja annak különböző lehetséges definícióit. Ezt követően a kínai jogi sajátosságok elemzésével kísérletet tesz arra, hogy megmagyarázza Kína nemzetközi joghoz fűződő viszonyának sajátosságait. Végül a dél-kínai-tengeri jogviták ismertetésén keresztül választ ad a címben megfogalmazott kérdésre. A szerzők véleménye szerint a jogi hadviselés koncepciója nem alkalmas analitikai elemzés céljára és a Kínai Népköztársaság viselkedését elsősorban történelmi és kulturális sajátosságok magyarázzák.
