A határokon átnyúló információcserét akadályozó és segítő tényezők

Absztrakt

A jelen tanulmány célja, hogy részletes betekintést nyújtson a nemzetközi rendészeti információcsere elméleteibe, és ezzel segítse a stratégiai szintű döntéshozókat abban, hogy hogyan javíthatják munkájukat és hatékonyságukat. A szerző ezt a célt a szervezeti együttműködés területének lényeges tudományos elméleteinek bemutatásával, valamint ezen ‘civil’ vélemények speciális rendészeti kontextusba történő átvételével igyekszik elérni. Az elméleti kiértékelés három fő környezetet azonosít, a szervezetit, a jogit és a technológiait (Yang and Maxwell, 2011), a rendészeti, határokon átnyúló információcsere segítő és hátráltató tényezőinek megtalálásához. A szervezeti környezeten belül a szerző megvizsgálja, hogy a bürokratikus szervezeti felépítés, a különféle szervezeti kultúrák, a bizalom, a kölcsönösség és a vezetőség hogyan befolyásolják az információ megosztásának folyamatát. Bemutatja az adott politikai környezet mellett a nemzeti és az EU jogalkotás hatásait. Ebben a részben vázolja továbbá a különféle adatvédelmi és magánéleti előírásokat, a harmonizált nemzeti szabályozások hiányának, és az eltérő politikai értelmezések következményeit is. Végezetül részletezi az akadályozó és támogató technológiai környezet jellemzőit. Itt vitatjuk meg az együttműködési képesség, a homogenitás témáit, valamint az Információs és Kommunikációs Technológia (ICT) állapotát és hatását a cserefolyamatra. A megállapításokra alapozva levonja a szükséges következtetéseket, és olyan ajánlásokat alakít ki, amelyek segítik az akadályok megszűntetését, és ezzel támogató szervezeti környezetet hoznak létre. A legfontosabb ajánlások: kerüljük a kényszerítő bürokráciát, támogassuk a transzformációs vezetői stílust és a közös szervezeti kultúrát, hozzunk létre egy egységes és összehangolt jogi hátteret a határokon átnyúló információcseréhez, alakítsunk ki egy információcserét segítő környezetet, és biztosítsuk az együttműködési készséget és a homogenitást.
