Abstract
This study examines the issue of liability and obligation of acting as a guarantor primarily through a general description of the Commercial Code of 1875, a significant milestone in the history of Hungarian commercial law. In doing so, the rules applicable to various forms of companies (occasional associations, general partnerships, limited partnerships, private limited companies, cooperatives) are analysed separately, with reference, in each case, to legal cases from the contemporary practice of the Hungarian Royal Curia.
